Because physical exercise can be strenuous and subject to risk of serious injury, E+ROSE fitness instructors urge you to obtain a physical examination from a doctor before beginning any exercise or training program. You agree that by participating in these physical exercise sessions , yoga or group fitness training activities, you do so entirely at your own risk. This includes, without limitation, (a) your use of all amenities and equipment in the facility and any on or off site location and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment (c) our instruction, training, supervision, or dietary recommendations. You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury. You expressly agree to release and discharge your personal trainer or instructor from Vitality, LLC & Diskin Cider and from any and all claims or causes of action. This waiver and release of liability includes, without limitation, all injuries to you which may occur, regardless of negligence or premises condition. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from. You acknowledge that you have carefully read this waiver and release and fully understand that it is a release of liability. You agree to voluntarily give up any right that you may otherwise have to bring a legal action against the trainer, instructor, or company for negligence, or any other personal injury or property damage or loss action.

I hereby acknowledge and agree to the following terms and conditions as a condition of my use of the facilities and services offered by Urban Sweat, including but not limited to saunas, cold plunges, and red light therapy (hereinafter referred to as “the Studio”):
Assumption of Risk:
I understand and acknowledge that the use of the Studio facilities and services involves inherent risks and dangers. These risks may include, but are not limited to, heat-related injuries, cold-related injuries, allergic reactions, and potential equipment malfunctions. I voluntarily assume all risks associated with the use of the Studio’s facilities and services.
Health and Medical Conditions:
I hereby certify that I am in good physical health and do not suffer from any medical or health conditions that could be aggravated or worsened by the use of the Studio’s facilities and services. I acknowledge that I have consulted with a healthcare professional if I have any concerns about my ability to safely participate.
Release of Liability:
In consideration for being allowed to use the Studio’s facilities and services, I hereby release, waive, and discharge Urban Sweat, its owners, employees, agents, and any other parties associated with the Studio from any and all liability, claims, demands, actions, or causes of action of any kind arising out of or related to any loss, damage, or injury, including death, that I may sustain while using the Studio’s facilities and services.
Indemnification:
I agree to indemnify and hold harmless Urban Sweat, its owners, employees, agents, and any other parties associated with the Studio from any and all claims, including legal fees and expenses, that may arise as a result of my use of the Studio’s facilities and services.
Photo and Video Release:
I grant permission to Urban Sweat to use any photographs, videos, or other media taken during my visit to the Studio for promotional and marketing purposes.
Severability:
If any provision of this liability waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
By agreeing above, I acknowledge that I have carefully read and fully understand the terms and conditions of this liability waiver, and I voluntarily agree to be bound by its terms.
