Because physical exercise can be strenuous and subject to risk of serious injury, E+ROSE fitness instructors urge you to obtain a physical examination from a doctor before beginning any exercise or training program. You agree that by participating in these physical exercise sessions, yoga or group fitness training activities, you do so entirely at your own risk. This includes, without limitation, (a) your use of all amenities and equipment in the facility and any on or off site location and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment (c) our instruction, training, supervision, or dietary recommendations. You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury. This waiver and release of liability includes, without limitation, all injuries to you which may occur, regardless of negligence or premises condition. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from. You acknowledge that you have carefully read this waiver and release and fully understand that it is a release of liability. You agree to voluntarily give up any right that you may otherwise have to bring a legal action against the trainer, instructor, or company for negligence, or any other personal injury or property damage or loss action.

1. Assumption of Risk: I, the undersigned, acknowledge that participation in fitness activities, including the use of gym equipment, spa services, personal training, and group fitness classes at FORTH Fitness Center involves inherent risks. These risks include, but are not limited to, muscle strains, sprains, and other potential injuries that may result in serious injury, illness, or death. I confirm that I am in good health and in proper physical condition to participate in such activities and do so at my own risk. I assume full responsibility for any injuries or damages that may occur to me or my property as a result of my participation.
1a. Cold Plunge Risk Acknowledgment: I acknowledge that participation in cold plunge activities involves inherent risks, including but not limited to cold shock, hypothermia, dizziness, fainting, and potential adverse effects on individuals with pre-existing medical conditions such as cardiovascular or respiratory issues. I confirm that I have consulted with a healthcare professional regarding my ability to safely participate in cold plunge activities. I agree to follow all guidelines provided by FORTH Fitness
Center staff and assume full responsibility for any injuries, health complications, or damages that may result from my participation in cold plunge activities.
2. Proper Use of Equipment: I agree to follow all equipment instructions carefully and, if necessary, to use a spotter when lifting. I understand that improper use of equipment can lead to injury, and I agree to exercise caution and adhere to all safety guidelines. I will maintain respectful boundaries and avoid dropping weights.
3. Cleanliness and Courtesy: I will sanitize equipment after use, return it to its proper place, and use the provided towel. I will avoid monopolizing equipment, maintain respectful boundaries, and be courteous to others at all times. I will keep my bags and personal belongings in lockers and avoid leaving them on the gym floor.
4. Dress Code: I understand that proper exercise clothing is required at all times, including clean clothing and closed-toe shoes. I will not wear any clothing that may pose a safety risk or is otherwise
inappropriate for a fitness environment.
5. Facility Conduct: I agree that personal training services are limited to contractors of FORTH Fitness Center and will not engage in or accept personal training services from non-contracted individuals. I will avoid loud personal phone conversations, using obscene or profane language, and listen to personal music via headphones only.
6. Health and Safety: I acknowledge the importance of being mindful of my health and the well-being of others. If I feel unwell, I will refrain from using the gym and wellness facilities. If I spill any liquid on the floor, I will clean it up immediately. I understand that management assumes no responsibility for any injuries that may occur.
7. Spa and Group Fitness Classes: I acknowledge that participation in spa services and group fitness classes involves risks, including but not limited to physical exertion, the use of oils or other products, and interaction with other participants. I agree to participate at my own risk and release FORTH Fitness Center from any liability related to these services. I understand that I am responsible for informing the instructor or therapist of any medical conditions or injuries that may affect my ability to safely participate.
8. Medical Consent: In the event of an emergency, I consent to receive medical treatment deemed advisable in the event of injury, accident, and/or illness during my participation in any activities at FORTH Fitness Center, including group fitness classes.
9. Prohibited Items and Activities: I will not bring glass containers into the gym, engage in horseplay, or bring food, alcohol, or tobacco products (including vaping) into the gym. I agree that only bottled water is allowed. I understand that no pets are allowed in the gym.
10. Age Restrictions: I understand that no person under the age of 16 is allowed in the gym.
11. Personal Belongings: I agree to be watchful of my belongings, as management is not responsible for lost or stolen items. I will report any faulty or damaged equipment to a staff member immediately and will not use such equipment.
12. Video and Photography: I understand that video recording and photography within the facility are strictly prohibited unless authorized by management. This policy is in place to ensure the privacy and comfort of all members.
13. Waiver and Release of Liability: In consideration of being allowed to participate in fitness activities, including the use of gym equipment, spa services, personal training, and group fitness classes at FORTH Fitness Center, I hereby release, waive, and discharge FORTH Fitness Center, its owners, officers, instructors, employees, agents, and representatives from any and all liability, claims, demands, or causes of action that may arise from or relate to my participation in these activities. This waiver and release extends to any claims arising from negligence on the part of FORTH Fitness Center or its employees.
14. Indemnification: I agree to indemnify and hold harmless FORTH Fitness Center, its owners, officers, employees, and agents from any and all claims, demands, liabilities, or expenses (including reasonable attorney’s fees) arising from or related to my use of the fitness center facilities.
15. Photo/Video Release: I grant FORTH Fitness Center permission to use any photographs or video recordings taken during my participation in group fitness classes or other activities for promotional purposes without compensation to me.
16. Agreement to Rules: I agree to abide by all rules and policies set forth by FORTH Fitness Center. I understand that failure to comply with these rules may result in the termination of my gym membership or access privileges.
17. Governing Law and Severability: This waiver and release of liability shall be governed by and construed in accordance with the laws of the State of Georgia. If any provision of this waiver and release of liability is found to be unenforceable, the remaining provisions shall remain in full force and effect.
18. Acknowledgment of Understanding: I have read this waiver of liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
