Because physical exercise can be strenuous and subject to risk of serious injury, E+ROSE fitness instructors urge you to obtain a physical examination from a doctor before beginning any exercise or training program. You agree that by participating in these physical exercise sessions , yoga or group fitness training activities, you do so entirely at your own risk. This includes, without limitation, (a) your use of all amenities and equipment in the facility and any on or off site location and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment (c) our instruction, training, supervision, or dietary recommendations. You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury. You expressly agree to release and discharge your personal trainer or instructor from Vitality, LLC & Diskin Cider and from any and all claims or causes of action. This waiver and release of liability includes, without limitation, all injuries to you which may occur, regardless of negligence or premises condition. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from. You acknowledge that you have carefully read this waiver and release and fully understand that it is a release of liability. You agree to voluntarily give up any right that you may otherwise have to bring a legal action against the trainer, instructor, or company for negligence, or any other personal injury or property damage or loss action.

This release, Waiver and Hold Harmless Agreement is made by and between the undersigned (Client) and Synergy Pilates Nashville, LLC and entered into on the day, month, and year noted below. I have volunteered to participate in a progressive exercise program and to retain the services of Synergy Pilates Nashville, LLC, and its teachers to receive physical training. I assume all risk of injury from my participation. To that end, I acknowledge and agree to all of the following:
1. Synergy Pilates Nashville, LLC provides space for and instruction in Pilates conditioning methods and exercise. The parties to this agreement recognize that Pilates, like any physical conditioning exercise program, could lead to physical injury to the client.
2. The exercise program utilizes the Pilates technique of muscle conditioning, strengthening, and stretching. The possible benefits of this program include improving cardiovascular fitness, muscle strength, flexibility, posture, and body alignment. During this exercise, there exists potential for muscle soreness or stiffness, abnormal blood pressure, fainting, irregular heartbeat, and other severe injuries, including the possible instance of heart attack and death. I assume all of the foregoing risks and accept personal responsibility for any other damages or other injuries I might suffer.
3. I know I have the right to choose what exercises I do or do not perform and may withdraw from any exercise at any time.
4. I understand that a physical examination and medical approval should be obtained prior to participating in an exercise program.
5. I recognize that Synergy Pilates Nashville, LLC will not be able to and will not provide its services to clients without the execution of this agreement and our detailed client profile.
6. I understand the Studio's Right to photograph the workout. Client shall permit Synergy Pilates Nashvilles or person(s) employed or engaged by Synergy Pilates Nashville, without compensation or consideration to Client, to take photographs at the Synergy Pilates Nashville site of workouts and while at Synergy Pilates Nashville, for purposes including, but not limited to, publication in newspapers, magazines, and other print media, use in broadcast media, publication via the Internet, and use in marketing materials used by Synergy Pilates Nashville. Such photographs and any accompanying descriptions shall not identify the Client or the property address of the project without the express written consent of the Client.

Therefore, client in consideration of the above and of the exercise classes to be provided, hereby waives all claims for damage or loss to a person or property which may be caused by any act, or failure to act, of Synergy Pilates instruction, staff, vehicle, and their officers, agents or employees. The client assumes the risk of all dangerous conditions in and around the mobile premises and waives any and all specific notice of the existence of such conditions. Client also assumes the risk of any and all injuries that might result from participation in the Synergy Pilates Nashville exercise program.

In consideration of my participation in the Synergy Pilates Nashville exercise program, I, myself, my heirs, and assigns, hereby release Synergy Pilates Nashville and its employees and owners from any claims, demands, and causes of action arising from my participation in the exercise program. I hereby affirm that I have read and fully understand the above.
